Default Help - Procedure for Changing Tapu

Looks like we will need to have our Tapu altered. The house is a triplex but the Tapu is for a duplex. Is it a complicated procedure, and if we need to hire a solicitor to do it what kind of charges are involved?

Hoping some of the agents on here might have come across this situation and be able to advise me.

Hi Taze

You will need to find out if your 3rd floor was added after the original paperwork for your house/complex was done. İts not unknown for builders to add on little extras afterwards. İn cases like that the "extra" bits are actually illegal as they dont comply with the original planning permission.

Hi Taze

yopu could ask your neighbours if they know what is on there Tapu that way it will give you an idea as to its the paper work or the villa if its the villa and you dont intend to sell why tell anyone its wrong you might open a big bag of worms and have more problems,

Let us know what it was and how you get over it please as this will add to our collective knowledge

Thanks for your replies. It's a semi detached villa on a site. All the houses are the same, but doubt if many have their Tapus because co-operative not wound up yet. I thought once the Tapu and Habitation Certificate had been issued everything must be legal and above board. The agent has the habitation certificate and I haven't seen it yet, but I do have the Tapu. I would prefer to get it sorted because although we aren't selling at the moment, if and when we do decide to sell I would rather not have to face the problems then.

Marlyn, this is certainly something to be added to your advice thread: if giving power of attorney, the person acting on your behalf should verify all details on Tapu before parting with your money.

My mums house in Guzelcamlı is shown as a dublex on the deeds but a bedroom and ensuite has been built under the roof. All houses on the sıte are the same.

Does this mean that if your mum decides to sell her house it will be sold as a duplex or a triplex, and how would it affect the value of the house. In other words, is it legal?

İs it legal??? İ dont honestly know. İ dont intend changing the deeds and causing myself any problems (the house is in my name). When the house is sold it will be done so with the original deeds.

İ dont think it will devalue the property.

I dont think waiting for the Tapu before paying monies is going to be practical as every deal i have heard of the Tapu always comes after and in recent months it has taken up to one year but if the situation changes i will ammend the buying guide it might be worth adding it is best to have site of the owners tapu or the site plans if a co-operative this would show what should have been built, i will ponder on this one and take some advice i think,

Don't you think it would make a difference to potential buyers if the Tapu is for a property with 2 floors and the house has 3 floors? It would definitely make a difference to me. Is this a common occurrence?

Marlyn: What I said was that the person acting on your behalf should verify the details on the Tapu before handing over your money. Nevertheless, I think that it would be wise for you to get advice on this because you wouldn't complete a property purchase at home without getting the deeds of the property so why would you do so in Turkey?
